When buying a property in Turkey, the legal procedures are really quite straight forward. However, in order to avoid any problems we recommend: 

  1. Use a good English speaking estate agent who can put you in touch with previous customers  for their recommendations. Whatever you do, do not buy a property through a friendly waiter, hotel receptionist, friend of a friend etc etc - the price is greatly inflated in 99% of these cases and Title Deeds etc can not be easily checked. Ask yourself -'would I do this if I was buying property in the UK?'

  2. Make sure the Title Deed is properly checked (see below)

Once a property has been chosen, Kent Estate Agency carry out the searches on the Title Deeds for you and ensure that it's clear of debts and that the seller is actually the person detailed on the Title Deed. Thereafter a deposit (usually 10% - 20% of the asking price but sometimes as much as 75% for new build properties) is placed in a bank account in Turkey (by electronic transfer - see 'Banking in Turkey') and paid to the seller on your behalf. There is then a wait of 3 - 6 months for the paperwork to be cleared by the officials & army departments in Izmir, Ankara & Mugla. As soon as the Marmaris Title Deeds Office receives clearance from the army department confirming that the property in question is not within an military area, the remaining balance plus any additional costs are transferred to the same bank account and the Title Deeds can be exchanged.

Unlike the UK, it is not necessary to use a solicitor to conduct the conveyancing for you. Kent Estate Agency can do this for you or we can recommend a good English speaking lawyer to you.  The Title Deeds formalities can all be carried out in your absence, by leaving a Power of Attorney with Kent Estate Agency or with your solicitor. Should you decide to use Kent Estate Agency for this work, we will take you to a notary to arrange this Power of Attorney (there is an official translator within the notary's office to ensure that you understand the Power of Attorney), open a bank account in your name with you and take you to have the necessary photos required for the paper work taken.

Surveys are not normally conducted on residential properties in Turkey however, should our customers need a survey, Kent Estate Agency are happy to be able to refer customers to a new British company, Turkish Property Surveys, who will be able to provide surveys direct to the customer.

The following Countries have agreements ('Reciprocal and Ratified Real Estate Agreements') with the Turkish Government. These agreements permit nationals of the following countries to purchase properties in Turkey - and vice versa.

Argentina, Australia, Austria, Barbados, Belgium, Brazil, Canada, Central African Republic, Chile, Colombia, Dominican Republic, El Salvador, France, Gabon, Germany, Guatemala, Greece, Israel, Italy, Kenya, Luxembourg, Malawi, Netherlands, Northern Cyprus Republic, Norway, Panama, Peru, Somalia, Spain, Tanzania, United Kingdom, United States of America and Venezuela.

For other nationals not listed above, special permission may be obtained from Ankara, taking up to six months to clear.

Additional costs

  • Kent Property Services charge 3% finders fee - over and above the
    final agreed price.

  • There is a Buyers Tax which is paid by the purchaser at the time of
    Title Deed transfer which is calculated on the rateable value of the
    property.

  • Annual ground rates are minimal.

  • Electricity is slightly cheaper than the UK.

  • Water is cheap.

  • There is a cost for electric and water registration when you purchase a property.

  • Furniture is well made and very reasonably priced.

  • Petrol is about the same price as the UK.

  • Cars and electrical equipment are more expensive here.
